H.R. 3672, the Armed Forces Transgender Dependent Protection Act (AFTDPA), protects the rights of transgender children and spouses of active duty service members. It ensures that gender dysphoria is protected by law as a qualification for EFMP enrollment. AFTDPA also prohibits DoD from assigning service members with transgender dependents to assignments in states or countries that prohibit or otherwise restrict medically necessary treatments for gender dysphoria. AFTDPA gives service members currently serving in a state that restricts medically necessary care for their dependents the option to PCS to another duty locationwithin 30 days of the law’s enactment.
